The city decides what gets planted at the curb
Clifton maintains an approved species list for trees planted along public streets and parks — oaks feature heavily — and requires a permit from Public Works to take down a tree over a threshold diameter on private property outside the right-of-way.
For a gutter that is the whole equation. Oak drops late and heavy, the street trees are not yours to remove, and the ones on your own lot need a permit. Capacity and guards are the lever you actually control.

Do I need a permit for gutters in Clifton?
No. N.J.A.C. 5:23-2.7(c)1xvi treats repair, replacement or installation of exterior gutters and leaders as ordinary maintenance with no building-type limitation — no permit, no inspection, no notice, on a house or a four-family alike. Clifton does keep a contractor-licensing chapter on its books, but N.J.S.A. 45:5AAA-14 supersedes municipal licensing of home improvement contractors — what the city retains is the permit and the inspection, neither of which this work needs. Ask every bidder for their state registration number and proof of insurance instead.
The city trees drop into my gutters. Can I have them cut back?
Not unilaterally. Clifton maintains an approved species list for street and park trees and controls what happens to them, and taking down a sizeable tree on your own property outside the right-of-way needs a permit from Public Works. Since the trees are largely fixed, the practical levers are capacity and protection — larger outlets, more downspouts, or guards suited to the leaf type. Oak, which is well represented on the approved list, drops late and heavily.
My building has four apartments. Is that different?
Not for gutters, and that is unusual. The gutter clause carries no building-type limit at all, so a four-family is treated exactly as a single-family — no permit. It is worth knowing because the other two exterior trades are the opposite: siding on a four-family is capped at 25% of wall area before a permit is needed, and the roofing exemption does not reach it at all.
