Egress Window Installation (Basement + Bedroom)
An egress window is an emergency escape and rescue opening, and in New Jersey which rulebook applies depends on whether the building already exists. Work inside a standing house falls under the Rehabilitation Subcode (N.J.A.C. 5:23-6), which requires that where the work creates a bedroom below the fourth floor, at least one window or exterior door in that room be operable, sit no more than 44 inches above the floor, and give a width of at least 20 inches, a height of at least 24 inches, and a total area of at least 5.7 square feet measured from head to sill and side to side. There is no reduced grade-floor allowance in that rule — the 5-square-foot figure people find online belongs to the model code's new-construction section. New construction and additions follow the one- and two-family dwelling subcode instead. We do the whole scope: cutting and squaring the opening, setting the lintel on sound bearing, installing the unit (usually a casement, because the whole sash swings clear and the entire opening counts), building the well, running the drainage to the footing drain or to daylight, and backfilling in compacted lifts. Permits are pulled under our NJHIC registration and we meet the Construction Official on site, so you get the approved permit, the manufacturer's published clear-opening documentation and pre-backfill photos of the lintel and drainage at closeout.

Read the NJ bedroom egress code guideAn egress window job is not a window job with a bigger window in it. It is a conformity project: you are taking a room that is not legally a bedroom and making it one, and the deliverable is a passed inspection, not a pane of glass. Most of the calls we get start the same way — a finished basement that has been used as a bedroom for years and just got flagged at a home inspection, a basement build-out where the architect drew a bedroom and the plan reviewer wrote the escape-opening rule across it, or an attic conversion where the existing window is beautiful and 30 inches too small.
Which code governs turns entirely on whether the building already exists, and this is where most of the egress advice online is simply wrong for New Jersey. New construction and additions follow the one- and two-family dwelling subcode — the IRC as adopted and amended at N.J.A.C. 5:23-3.21. Work inside a building that is already standing follows a different document: the Rehabilitation Subcode, N.J.A.C. 5:23-6, which by its own terms controls all repair, renovation, alteration, reconstruction, change of use and addition work on every existing building in the State. New Jersey deleted the residential code's own existing-building egress sections from its adoption precisely because the Rehabilitation Subcode covers that ground instead. Nearly every basement bedroom we are called about is Rehabilitation Subcode work, and its test is not identical to the model-code numbers that circulate online. What varies enormously is what it costs to satisfy in your particular house — because the window is rarely the expensive part. The foundation is. We do this work across all 21 counties: cutting the opening, setting the lintel, installing the unit, building the well, running the drainage, pulling the permit under our NJHIC license and meeting the inspector.
What actually triggers an egress window
In New Jersey the trigger is the work, not the room. The Rehabilitation Subcode's requirement for one- and two-family dwellings sits at N.J.A.C. 5:23-6.27(b)2, and it turns on a single condition: when the work being performed creates a bedroom below the fourth floor, at least one window or exterior door in that sleeping room has to meet the escape-opening test. Parallel provisions catch the same thing from other directions — an alteration that creates a new window opening or changes the size of an existing one in a sleeping room (5:23-6.6), any newly created window opening in a sleeping room (5:23-6.9), and a change of use into a residential group (5:23-6.31). The same two exceptions run through all of them: no compliant opening is required where the sleeping room has a door to a corridor with access to two remote exits, or where the building is sprinklered throughout.
What is not a trigger surprises people more. An existing basement does not need an escape opening merely for being a basement. When New Jersey adopted the residential code it struck the words 'Basements, habitable attics and' from the front of the escape-opening section, so even in new construction the requirement attaches to sleeping rooms — not to basements as such and not to habitable attics. And the Rehabilitation Subcode says plainly that windows may be replaced with windows like those existing without meeting the size requirements; it is changing the opening size, or creating a bedroom, that pulls the rule in. So a basement finish that adds a family room and one that adds a guest bedroom are two different code outcomes in the same square footage. Calling the room an office on the plans and putting a bed in it later is a strategy we've watched blow up at resale more than once. Additions sit on the other side of the line entirely — N.J.A.C. 5:23-6.32 sends any addition to the new-construction code, so a bedroom built in a new addition is judged by the dwelling subcode rather than by the rehab rules.
The third trigger is the one nobody plans for: the sale. Egress is one of the most common items flagged on a NJ home inspection and one of the few that a buyer's attorney will hold a closing over, because it is a life-safety item with a bright-line code test. Retrofitting it under contract, on a clock, with a permit that has to be pulled and inspected before closing, is the worst version of this job. If you know a sale is coming, this is work to do a season ahead.
The dimensions the opening has to hit
For work in an existing building the Rehabilitation Subcode states the whole test in one sentence, and it is stricter than the number most homeowners find online. The window has to be operable, the sill can sit no more than 44 inches above the floor, and the opening has to have a width of at least 20 inches, a height of at least 24 inches, and a minimum total area of 5.7 square feet measured from head to sill and side to side. There is no five-square-foot allowance for grade-floor or below-grade openings in the rehabilitation rule. That reduction exists in the model residential code's new-construction section, it is the figure every national egress article quotes, and it does not travel into work on a house that is already standing. On a basement retrofit, 5.7 square feet is the number. The width and height are independent minimums rather than an either/or with the area, which is why a 20-inch-wide opening has to be over three feet tall to qualify.
Two things about those numbers cause nearly all the field surprises. First, the area is the hole a body fits through with the sash fully open — not the rough opening, not the glass, not the unit's nominal size. Frame, sash thickness and operating hardware all eat into it. Second, style changes the math dramatically: a double-hung gives you roughly half its height, a casement swings the whole sash out of the way. Swapping style is frequently how an opening that fails becomes an opening that passes without touching the foundation, and it is the first thing we check before quoting concrete work.
We verify the clear opening off the manufacturer's published figures for the exact unit before anything is ordered, and we hand those figures to the inspector at the final. Where a job is genuinely a marginal call — an opening a hair under, a room whose classification is arguable — we take it to the Construction Official before we quote it rather than after we have cut concrete.
Cutting the opening: the foundation decides the project
For a basement bedroom, essentially every existing opening is too small, so the real scope is making a hole in a foundation wall. What that costs in time and disruption is set almost entirely by what the wall is made of.
Poured concrete cuts cleanly and predictably. A track-mounted or ring saw scores the perimeter, the block comes out in pieces, and the resulting opening is square and stable. Concrete block is nearly as straightforward but wants care at the coursing — you cut on the joints where you can, and grout-fill and reinforce the cells adjacent to the new jambs. Stone, rubble and brick foundations are the hard case: there is no coursing to work with, the wall carries load through interlock rather than through a monolithic section, and removing material is genuinely destabilizing. Those walls get shored and needled before anything is cut, and they get an engineer's eyes on them.
Whatever the wall, the opening needs a header over it — a steel lintel or a precast concrete lintel bearing on sound wall on each side, sized for the load above. This is the part that separates a permitted egress install from the ones we get called to fix. We have opened up more than one basement wall to find a previous window sitting under nothing but a course of block, with a hairline stepping up diagonally from each corner.
The things that actually move the schedule are usually outside the wall, not in it. Where the excavator can reach; whether the well lands on a gas or electric service, a hose bib, a dryer vent, an A/C line set or a sprinkler zone; whether a deck, a patio slab, a driveway or a mature tree sits exactly where the well has to go; and how far below grade the sill has to sit. On the inside, the opening has to clear framing, ductwork and panel clearances — and the deeper the excavation, the more the well drives the number rather than the window doing it. If the wall is load-bearing in an unusual way or the foundation is stone, a structural engineer is part of the scope and we say so at the estimate rather than at the framing inspection. The well, the ladder and the drainage
This is where the internet and the New Jersey rulebook part company again. The well figures everybody quotes — a horizontal area of not less than 9 square feet, with both the horizontal projection and the width not less than 36 inches — come from the window-well section of the new-construction one- and two-family dwelling subcode. The Rehabilitation Subcode does not carry that section into work on an existing building; the list of residential code sections it does adopt for materials and methods leaves the escape-opening section out entirely. We build retrofit wells to those dimensions anyway, and we would tell you to insist on it, for a reason that has nothing to do with which subcode is stamped on the permit: a well sized to the letter of an area rule but shaped so a casement cannot swing produces an opening nobody can actually get through. Practice varies by township — some Construction Officials apply the new-construction figures to retrofits outright — so we confirm the local expectation before anyone digs.
Depth changes the scope. Past 44 inches of well depth the new-construction rule calls for a permanently affixed ladder or steps, usable with the window in the fully open position. Those ladders are not stairs and are not held to the stair code, but they do have their own dimensions: an inside width of not less than 12 inches, a projection of not less than 3 inches from the wall, and rungs spaced not more than 18 inches apart vertically for the full height of the well. The ladder is allowed to encroach only a limited amount into the well's required dimensions, which is why an undersized well plus a ladder is a common way to fail an inspection that would otherwise have passed. Same note as above — those are new-construction figures and we build deep retrofit wells to them as our own standard, because the alternative on a deep well is an escape opening a child or an older adult cannot climb out of.
Drainage is the requirement that does reach your retrofit, and it is the one that gets skipped. The Rehabilitation Subcode pulls the plumbing subcode's window well drain provision into rehabilitation work explicitly, and applies it to newly created window wells — so if we are cutting a new well, it gets a drain. In practice, on most of the NJ jobs we see, that means a stone-filled sump in the well floor tied to the footing drain, or a dedicated line run to daylight where grade allows. A well with a solid floor and no outlet is a bucket set against your foundation, and the first heavy rain after the leaves fall proves it.
Product-wise the well is either a corrugated galvanized steel unit with integral steps, a molded polyethylene terraced well, or a poured or block well built in place. The molded and terraced wells are the easiest way to satisfy the climbing requirement on a deep well, because the steps are formed in. Built-in-place wells give you a better look on a visible elevation and more freedom on shape when a deck post or a service line is in the way.
Permit, inspection and the sequencing that costs people money
Egress work is permitted work. Cutting a foundation, setting a lintel and changing an opening size are all construction the local Construction Official reviews and inspects, and on a basement finish the egress opening is inspected as part of a larger job that also has framing, electrical, insulation and fire-protection inspections. We pull the permit under our NJHIC license, submit what the reviewer asks for, and meet the inspector on site. You do not deal with the township.
The sequencing mistake we see constantly on basement finishes: the homeowner or their contractor frames, wires, insulates and boards the room, and the egress opening goes in last because the window has a lead time. The inspector then has to sign off on framing he can no longer see, and in the worst version the finished opening misses a dimension and the drywall comes back off. Egress goes in early. The opening, the lintel, the unit and the well should be complete and inspected before anything closes up in front of it.
The other one is the well cover, and here the Rehabilitation Subcode is explicit: bars, grilles and screens shall not be placed over emergency escape windows or doors in residential groups unless they are releasable or removable from the inside without a key, a tool, or more force than the normal operation of the window takes. A latched grate, a screwed-down panel or a locked lid over an egress well converts a compliant installation into a non-compliant one, and it is usually added by a homeowner months after the inspector left.
At closeout you get the approved permit, the manufacturer's published net-clear-opening documentation for the installed unit, and photographs of the lintel and the drainage detail before backfill. That package is what answers the question the next home inspector is going to ask, and it is worth more at resale than the window is.
